When Aer Lingus has to pay

Aer Lingus must pay compensation under EU261 or UK261 for disrupted flights departing from Europe or the UK, and for flights arriving there from elsewhere, because Aer Lingus is a European airline.

  • Delay: you reached your final destination 3 hours or more after the scheduled arrival time.
  • Cancellation: you were told less than 14 days before departure, and the replacement did not get you there close to the original time.
  • Denied boarding: the flight was overbooked and you did not give up your seat voluntarily.

When the airline does not have to pay

Airlines are excused when the disruption was caused by extraordinary circumstances outside their control, such as severe weather, air traffic control restrictions or a security alert. Technical faults, crew shortages and strikes by the airline's own staff usually do not count. Airlines sometimes cite extraordinary circumstances without evidence, so your letter asks them to prove it for your specific flight.
